1. Who you are contracting with

Legal business name: Cyber Company. These Terms & Conditions ("Terms") govern your use of the website and services (the "Service") provided by Cyber Company ("we", "us", "our"), the seller and legal entity operating the Service. By creating an account or continuing to use the Service, you agree to these Terms and are contracting with Cyber Company. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind it.

2. The Service

Cyber Company provides an AI agent platform that lets users create, configure, run, and connect autonomous AI agents to third-party tools. Specific features available to you depend on your subscription plan.

3. Account and credentials

You must provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

4. Acceptable use

You must not misuse the Service. In particular, you must not:

  • use the Service for unlawful, fraudulent, or abusive purposes;
  • send spam or unsolicited messages;
  • infringe intellectual property or privacy rights of others;
  • upload malware or attempt to probe, scan, scrape, or otherwise interfere with the security or integrity of the Service;
  • use AI agents to generate illegal content, deepfakes, hate speech, malware, or content designed to jailbreak other systems;
  • reverse engineer, resell, redistribute, or circumvent technical limits of the Service.

5. AI-generated content

You are responsible for the prompts you submit, how you use outputs, verifying their accuracy, and having the rights to any content you input. Outputs may be inaccurate or unsuitable for regulated professional advice (legal, medical, financial) without independent human oversight. We may remove or restrict content, refuse or filter outputs, and suspend accounts to enforce these Terms or applicable law. Repeated infringement of third-party rights may result in termination; rights holders can report content through the Contact channel.

6. Intellectual property

Cyber Company retains all right, title, and interest in the Service, including software, documentation, and branding. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your subscription plan. You retain ownership of your inputs and outputs, subject to our right to host and process them to provide the Service.

7. Payment, subscriptions, and taxes

Paid plans are billed on a recurring basis according to the interval you selected. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

8. Service level

We work to make the Service reliable but do not guarantee uninterrupted or error-free performance. We may modify, suspend, or discontinue features at any time.

9. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the Service ends and we may delete your data after a reasonable export window.

10. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability arising out of or relating to these Terms is capped at the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We exclude liability for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury where the law forbids exclusion.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes; continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Cyber Company is established, and the competent courts of that jurisdiction have exclusive jurisdiction over any dispute.
